You agree not to use the SendMyRingtone Service to:
- Publish, distribute and/ or disseminate any harmful, obscene, indecent, unlawful, libelous, profane, defamatory, pornographic, infringing, drug dealing, gambling, harassment, stalking, spamming, inappropriate, hateful, or racially, ethnically or otherwise objectionable material or information.
- Submit, upload, make available, or send Materials that contains nudity.
- Use other Members' personal data for purposes other than establishing contact that is reasonably expected to be welcomed by such other Members
- Submit, upload, make available, or send Materials that are unlawful or promote or encourage illegal activity.
-Submit, upload, post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights.
- Attempt to gain unauthorized access to the SendMyRingtone Service, other accounts, computer systems.
Proprietary Rights
By submitting, posting, uploading, sending or displaying any Materials on SendMyRingtone Service, you hereby grant to SendMyRingtone a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Materials solely on and through the SendMyRingtone Service. The license you grant to SendMyRingtone is non-exclusive, fully-paid and royalty-free (meaning that SendMyRingtone is not required to pay you for the use on the SendMyRingtone Service of the Materials that you post). SendMyRingtone reserves the right to remove all of your Materials from your Profile page or other Member's pages. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Materials posted by you to or through the SendMyRingtone Service.
Copyright Policy
You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. SendMyRingtone respects the intellectual property rights of others. If you believe your work has been copied in a way that constitutes copyright infringement or are aware of any infringing material on the Web site, please contact us and provide us with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Web site (including a URL and/or screen shot); your email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
